IMPORTANT COURT CASES:
- The United States Supreme Court held that children with disabilities are entitled to “specialized instruction and related services which are individually designed to provide educational benefit”. The Court further held that they were not necessarily entitled to the “best” education nor were they entitled to an education that would “maximize” their potential. Rowley, 458 U.S. 176 (1982).
- More recently, the United States Supreme Court held that schools must offer an Individual Education Plan (IEP) that is “reasonably calculated to enable a child to make progress appropriate in light of the child’s circumstances” and “unique needs”. Endrew F. v. Douglas County School District, 137 S.Ct. 988 (2017).
